1. Overview
Tortus LLC ("Company," "we," "us," or "our") respects the intellectual property rights of others and expects users of the Tortus platform (the "Platform") to do the same. This policy describes how we respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA").
It is our policy to (a) respond expeditiously to valid notices of claimed copyright infringement, (b) remove or disable access to material we determine in good faith to be infringing, and (c) terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
2. Reporting Claimed Infringement (DMCA Takedown Notice)
If you are a copyright owner, or authorized to act on behalf of one, and you believe that material available on the Platform infringes your copyright, you may submit a written notice (a "Notice") to our Designated Copyright Agent identified in Section 3 below.
To be effective under the DMCA, your Notice must include substantially the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single Notice, a representative list of such works;
- Identification of the material that is claimed to be infringing and that is to be removed or disabled, with information reasonably sufficient to permit us to locate the material (for example, the URL or a description of where it appears on the Platform);
- Your contact information, including your name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement, made under penalty of perjury, that the information in the Notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
Please note that under 17 U.S.C. § 512(f), you may be liable for damages, including costs and attorneys' fees, if you knowingly materially misrepresent that material is infringing.
3. Designated Copyright Agent
Notices of claimed infringement should be directed to:
Copyright Agent
Tortus LLC
Email: dmca@tortus.io
To ensure a prompt response, please send your Notice by email and include "DMCA Notice" in the subject line. We may be unable to act on Notices that do not substantially comply with the requirements in Section 2.
4. Listing and MLS-Sourced Content
Portions of the Platform display real estate listing content licensed from one or more Multiple Listing Services ("MLSs") and their data distributors. If a Notice concerns listing content sourced from an MLS or its distributor, we will, in addition to acting on the Notice ourselves, forward the Notice to the applicable MLS and to the data distributor's designated copyright agent promptly, and in any event within twenty-four (24) hours of receipt, so that the source provider may take any action it deems appropriate. This reflects our obligations under our data-distribution agreements and does not limit any other rights or remedies available to the copyright owner.
5. Counter-Notification
If you believe that material you posted to the Platform was removed or disabled by mistake or misidentification, you may submit a written counter-notification (a "Counter-Notice") to our Designated Copyright Agent. To be effective, your Counter-Notice must include substantially the following:
- Your physical or electronic signature;
- Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled;
- A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material;
- Your name, mailing address, telephone number, and email address; and
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original Notice or an agent of that person.
Upon receipt of a valid Counter-Notice, we may forward it to the person who submitted the original Notice. If that person does not notify us within ten (10) business days that they have filed an action seeking a court order to restrain the allegedly infringing activity, we may, in our discretion, restore the removed material.
6. Repeat Infringers
In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are determined to be repeat infringers. We may also, at our sole discretion, limit access to the Platform or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.
7. Changes to This Policy
We may update this DMCA Copyright Policy from time to time. The "Last Updated" date at the top of this page indicates when this policy was last revised. Your continued use of the Platform after any change constitutes your acceptance of the revised policy.
8. Contact
For general questions about this policy that are not formal Notices, you may contact us at support@tortus.io. Formal DMCA Notices and Counter-Notices must be sent to the Designated Copyright Agent identified in Section 3.
